HW, married to SJW in a community of property, embarked on an extramarital affair with RS in 2015. In 2017, he made significant withdrawals from his investment account, totaling over R850,000, with the intention of hiding this money from his wife in case of a divorce. He then transferred R610,000 to RS in two payments, claiming it was a loan.
However, RS had a different story to tell. She argued that the money was a donation to help her struggling business, and she expected HW to follow through on his promise to divorce his wife and commit exclusively to her. RS believed the money was a sign of his commitment.
HW, on the other hand, defended his actions by saying he intended to leave his wife but hadn't decided on a permanent relationship with RS. He wanted to 'wait and see' how the divorce proceedings played out.
Judge Stuart David James Wilson, who heard the case, expressed serious doubts about HW's credibility, citing his dishonest intentions to scheme money away from his wife. The judge ruled in RS's favor, stating that HW failed to prove his case.
But the story doesn't end there. During the appeal, the high court examined WhatsApp messages between RS and HW, where he repeatedly referred to the payments as a loan and asked for repayment. RS's responses, such as 'I know I owe you' and 'I will pay you soon,' seemed to acknowledge the debt.
The court found these messages to be a candid record of their dealings, with RS making repeated promises to repay the money. Additionally, the court deemed it highly unlikely that HW, in the context of a troubled marriage and potential divorce, would donate such a large sum to a business he had no financial stake in.
In a comprehensive assessment of the evidence, the court ruled that the plaintiffs (HW and his wife) had proven their case. The WhatsApp messages, RS's banking records, and the circumstances surrounding the transfers all pointed to the advances being loans.
As a result, RS was ordered to repay the full amount, plus interest, and cover the costs of the legal application.
